Here at 7digital, we are committed to providing an excellent user experience, and to protecting and respecting your privacy while we do so. This policy (and the other documents referred to in it) details how 7digital limited and its subsidiaries (collectively "7digital", "we" "us" or "our") collect, use disclose and protect any personal data we collect from you, or that you provide to us.
Please read the following carefully to understand our view and practices regarding your personal data and how we will treat it. By visiting our website located at https://ca.7digital.com and/or using or accessing our services available on our website or mobile application (app) and/or through a third party website, portal, app or service powered by 7digital for a third party ("Third Party Service"), or agreeing to a contract with 7digital to purchase or subscribe to products, digital content and services, you are accepting and consenting to the practices described in this policy.
The data controller for the collection and processing of your personal data is 7digital limited, a limited liability company registered in England and Wales under company number 04843573 whose registered office is at 69 Wilson Street, London, United Kingdom EC2A 2BB.
As used in this policy, the term "personal data" means any information that identifies or can be used to identify a living individual either alone or in combination with other data.
IMPORTANT: If you are accessing the services via a Third Party Service, you are also accepting the practices described in the Third Party Service’s privacy policy, which you should also review carefully. Any information that you enter on the Third Party Service or on the 7digital pages, fields or resources that are integrated with the Third Party Service may, where you have agreed, be shared with the owner of the Third Party Service for marketing purposes as described in this policy. We are not responsible for the privacy practices of the Third Party Services.

1. What information do we collect about you?
When you visit our websites, mobile apps and/or use our services, we may automatically capture and record information about your visit from your web browser or from interactions with our apps, products and services, such as the full Uniform Resource Locators (URL) clickstream to, through and from our website (including date and time); products you viewed or searched for; page response times; download errors; length of visits to certain pages; page interaction information (such as scrolling, clicks, and mouse movements); and methods used to browse away from a page. We may also gather technical device information, such as date, time, connection speed, IP address, device location, browser type and version, operating system and platform. We (or our third party technical service providers acting on our behalf) may also use web beaconing technology to facilitate information tracking, and/or utilise ‘local storage’ to store your user preferences. If you register for an account with us, you will be asked to provide basic personal information so that we can create your account or send you a newsletter, including your name, email address and other basic contact information.
If you go on to make a purchase, you will be required to provide your billing address and card details. The majority of payment details are not collected by 7digital but instead by our third party payment processors Chase Paymentech Europe Limited and PayPal Inc.
If you enter a competition, you may be required to provide personal information such as name, email address and/or address.
Information we receive from other sources, we may receive information about you if you use any of the other websites we operate or the other services we provide including the Third Party Services that we operate on behalf of our clients. We are also working closely with other third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you, including but not limited to demographic information, from them.
If you register for an API Key, you will be asked to provide your name, email address and other basic contact details as part of the application process.
2. How do we use your information?
This section sets out how we use your information:
Information on website use and any information we receive from other sources, is generally stored and analysed on an aggregated basis and used by us to monitor and improve the performance of our technology and the design of our website and services. For security reasons, some information may also be logged and kept for our internal security audit log, which may be linked to your IP address. Certain information on search criteria and results may be used to provide aggregated trend analysis for internal use. We may also use this to tailor our music intelligence services, to make suggestions and recommendations to you and other users of our website or apps about goods or services we offer that may interest you or them.
Registered user details, if you have registered for an account with us we will principally use your information to provide you with the information, products and services that you request from us. Music rights holders also require us to tailor our product offering depending on where you are based. We may use your email address to send you service announcements, and to ensure that content from our website or apps is presented in the most effective manner for you. We may also use information on listening and purchase history to provide aggregated trend analysis for internal use. If you have signed up to receive newsletters or marketing information, we will send information about goods or services we feel may interest you.
Payment information, is principally dealt with by our third party payment processor and will therefore only be used by us to check that it is a valid method of payment and to validate your location. Payment information is not kept by 7digital other than in anonymised form, to facilitate the provision of the services to you (for example, where you ask us to store your credit or debit card number for quick payment). You will always be able to remove any such stored payment details.
If you enter a competition, information you provide may be used to contact you about competition results, and where you have consented, further marketing purposes as notified at the time of data collection. We may also notify you that your personal information will be shared with specified third parties, as set out below.
3. Who do we share your information with?
Your registered details, in order to provide our services to you we may share your information (and associated identifiable website and/or app usage data) with selected third parties, including:
- Authorised business partners, suppliers and sub-contractors who perform services for us (including data storage, security and technical testing and analysis, sales, marketing, fraud investigations, and bill collection) based on our instructions. These third parties may only use or disclose personal data obtained from 7digital to perform services on our behalf or comply with legal obligations;
- Our third party payment processors Chase Paymentech Europe Limited and PayPal Inc. for the purpose of processing your payment details and purchasing content and services from us;
- With the owners of the Third Party Services or other selected third party partners to enable them to send you marketing or promotional emails or contact you in connection with a competition we may be running. In these circumstances, we will operate as joint data controllers with the relevant third party, as set out at the top of this Privacy Policy;

- In certain circumstances (e.g. sale or purchase of business assets), or where we are under a duty to disclose or share your personal data in order to comply with any legal obligation or legal process, or to enforce our Mobile & Website Terms and our Terms of Service and other agreements;
- To protect the rights, property, or safety of 7digital, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection; or
- Other members of the 7digital family of companies for the purposes described in this privacy policy, such as to: (i) provide services and joint content (e.g. registration, sales, provision and hosting of content, and customer support); (ii) help detect and prevent potentially illegal acts and violations of our policies; and (iii) guide our decisions about our products, services and communications.
Marketing,
Where you choose to enter a competition or opt in to receive marketing or promotional information, we will share your data with select third parties as set out below:
- Marketing: 7digital will allow you to choose whether to receive mailings from record labels and/or other selected third party promotional partners that we believe may be of interest to you. Such lists are strictly optional, on an opt-in basis and may be unsubscribed from at any time; and
- Competition entry, where we are running a competition in conjunction with a third party we will notify you at the point of collection that we will share your information with such third party, and you will be able to choose whether or not to proceed.

Anonymised and aggregated data, we may also share your website and/or app usage, purchase history, or demographic data in an anonymised and aggregated form with:
- Analytics and search engine providers that assist us in the improvement and optimisation of our site;
- Advertising and affiliate networks that utilise the data to select and serve relevant adverts to you and others on our website or elsewhere; and/or
- Music intelligence partners for the compilation of sales charts, and the analysis of data such as search criteria, results, downloads and purchases (for example, to provide search and recommendation services for music you might like).
When we share your personal data with a third party, they must contractually agree to comply with privacy and security standard at least as stringent as 7digital's when handling similar data. When you provide data directly to the third party, the processing is based on their standards (which might not be the same as 7digital's) and your own independent relationship with that provider
4. Cookies and other tracking technologies: Our website and services use cookies and other software tracking technologies like clear gifs or web beacons to distinguish you from other users of our website and/or services. This helps us to provide you with a good experience when you browse our website and/or use our services and also allows us to improve our website and services. 5. Storage and transfer of information to other countries
The data that we collect from you is principally stored in the UK, but may be transferred to, and stored at, a destination outside the European Economic Area (EEA) to be processed by our third party processors for the purposes identified in this privacy policy. It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy. When your personal data is transferred to countries outside the EEA, please be aware that those countries may not have as comprehensive data protection laws as the country from which we initially obtained the information, and the recipients of your personal data in those countries may be subject to disclosure laws which could make the information accessible to law enforcement and national security authorities. If you are located in the EEA, we comply with applicable legal requirements providing adequate protection for the transfer of personal data outside of the EEA.
6. Your rights, and details
Marketing communications: You have the right to choose whether your personal data is processed for marketing or promotional purposes by us and/or third parties. We will inform you (before collecting your personal data) if we intend to use your personal data ourselves or transfer it to a third party for marketing purposes. You can exercise your right to prevent such processing at the outset by checking certain boxes on the forms we use to collect your data. If you change your mind later you can unsubscribe from marketing or promotional emails using the unsubscribe link on the relevant email, or contact us. If you opt out, we may still send you non-promotional emails, such as emails about your account or our on-going relations.
Account information: you may access, update and correct your account information and account preferences at any time by logging onto your account and updating your information and preferences. If you would like us to deactivate your account, please just let us know but note that we may retain certain information as required by law or for legitimate business purposes. If you wish us to permanently delete your account and personal information, please just let us know.

Limits on Collection: We will not collect information indiscriminately and will limit collection of information to that which is reasonable and necessary for the above purposes. We will also collect information as is otherwise authorized by law.
Limits on Using, Disclosing and Retaining Personal Information: We will only use and disclose your personal information for the purposes set out above and as authorized by law. We will keep personal information used to make a decision affecting you for at least one year after using it to make the decision, unless otherwise permitted or required by law. We will destroy, erase or make anonymous documents or other records containing personal information as soon as it is reasonable to assume that the original purpose is no longer being served by retention of the information and retention is no longer necessary for legal or business purposes. We will take due care when destroying personal information so as to prevent unauthorized access to the information.
Accuracy: We will make a reasonable effort to ensure that personal information we are using or disclosing is accurate and complete. In some cases, we rely on you to ensure that certain information, such as your address or telephone number, is current, complete and accurate. If you demonstrate the inaccuracy or incompleteness of personal information, we will amend the information as required. If appropriate, we will send the amended information to third parties to whom the information has been disclosed. When a challenge regarding the accuracy of personal information is not resolved to your satisfaction, we will annotate the personal information under its control with a note that the correction was requested but not made.
Providing Access: Upon written request and authentication of identity, we will provide you with your other personal information under our control, information about the ways in which that information is being used and a description of the individuals and organizations to whom that information has been disclosed. We will make the information available within 30 days or provide written notice where additional time is required to fulfil the request.
In some situations we may not be able to provide access to certain personal information. This may be the case where, for example, disclosure would reveal personal information about another individual, the personal information is protected by solicitor/client privilege, the information was collected for the purpose of an investigation or where disclosure of the information would reveal confidential commercial information that, if disclosed, could harm our competitive position. We may also be prevented by law from providing access to certain personal information.
Where an access request is refused, we will notify you in writing, document the reasons for refusal and outline further steps which are available to you.
7. Third party websites and Links
Our website and/or apps may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.
8. Your account details and security
7digital has implemented technology and security features, as well as strict internal guidelines, to safeguard the privacy of your personal data from unauthorised access or improper use. We employ SSL encryption to secure your personal data and payment information. We will continue to enhance our security procedures as new technology becomes available. While we make every effort to ensure that your information is secure on our system, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk.
If a particular service requires you to open an account you will complete a registration process by providing certain information for use with that service. You are responsible for maintaining the confidentiality of your password. You may have a credit card or other payment method stored with 7digital’s payment processor, and if your password is used by a third party (whether or not authorised) the third party will be able to make purchases with that payment method. You will be fully liable for any actions made with your account details where you have not kept your password secure. 7digital advises you to change your password frequently and to always keep it secure.
You agree to immediately notify us of any unauthorised use of your account or any other breach of security. In no event will 7digital be liable for any indirect or consequential loss or damage resulting from the disclosure of your user information. If you believe someone has accessed any service using your user information without your authorisation, it is your responsibility to set up a new password or contact us to delete your account.
9. Updates to this Privacy Policy
We may update this privacy policy at any time. Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, we may also notify you by e-mail. And, where required, we will seek appropriate consent prior to new use. Please do check back for updates to the policy.
